OLD LYME ZONING BOARD OF APPEALS
REGULAR MEETING
TUESDAY, JULY 17, 2012
MEMORIAL TOWN HALL, 52 LYME STREET
OLD LYME, CT - 7:30 P.M.

Present and voting were Judy McQuade, Vice Chairman (acting as Chairman), Kip Kotzan, Secretary, Arthur Sibley, regular member, Richard Smith, alternate (seated for Susanne Stutts) and Mary Stone, alternate (seated for Joseph St. Germain)

Present: Kim Barrows, Clerk

Absent:  Susanne Stutts, Chairman, Joseph St. Germain, regular member, and Martha Rumskas, alternate

Case 12-19 – Steven E. & Donna P. Currier, 22 Wildwood Drive

A Motion was made by A. Sibley, seconded by D. Smith to GRANT the necessary variances to construct the lean-to and attach it to the existing barn with the covenant that no additional additions to the structure will bee made and it will remain open.  The owner will not expect to come to the ZBA for any future variances for that structure.  Discussion:  M. Stone stated that the owner could just put a blue tarp over the boat, this will be a net gain to the neighborhood.  J. McQuade stated that the lot and structure currently are conforming, by adding the lean-to it becomes nonconforming.  Due to the condition, it will not be an enclosed space and the neighbor most affected does not object. No further discussion and a vote was taken.  In favor:  K. Kotzan, A. Sibley, R. Smith, M. Stone   In opposition:  J. McQuade   Abstaining:  None   The motion passed. 4-1-0

Reasons for granting:  Minimal intrusion into the setback.  Structure is not to be enclosed.  No objection from the neighbor who was most affected.   

Case 12-20 – Louis & Nancy Rossi, 22 Massachusetts Road

A Motion was made by K. Kotzan, seconded by A. Sibley to GRANT the necessary variances to build as per plans submitted.  No discussion and a vote was taken.  In favor:  J. McQuade, K. Kotzan, A. Sibley, R. Smith, M. Stone   In opposition:  None   Opposed:   None  The Motion passed unanimously.  5-0-0

Reasons to grant:  The original plan submitted in February was very ambitious.  Applicants amended the plans to take into account the feedback from the Board.  The addition to the rear is within the setbacks.  

Case 12-21 – Nicholas DiCorleto, 42 Breen Avenue

A Motion was made by K. Kotzan, seconded by A. Sibley to CONTINUE THE PUBLIC HEARING ON Case 12-21 – DiCorleto, 42 Breen Avenue to the September 18, 2012 Regular Meeting.  No discussion and a vote was taken.  In favor:  J. McQuade, K. Kotzan, A. Sibley, R. Smith, M. Stone   In opposition:  None   Opposed:   None  The Motion passed unanimously.  5-0-0

Adjournment

A Motion was made by K. Kotzan, seconded by D. Smith to adjourn the July 17, 2012 Regular Meeting; no discussion and a vote was taken.  The motion to adjourn passed unanimously.  5-0-0   The meeting adjourned at 9:30 p.m.
